The help section is intended to give practical guidance in how to complete the response form. It is not intended to provide legal advice for specific cases, and you are encouraged to obtain your own independent advice if you are unsure how to complete the forms.
Case reference & disputed domain name(s)
Please quote the case reference, which can be found in the top right-hand corner of the complaint, as well as the first domain name listed under the "Disputed Domain Name(s)" section of the complaint. This will enable us to match up your response to the complaint. If the complaints lists two numbers (e.g. 2834 and 1738) either one will do: one was a temporary number, but we can still locate it. The lower of the two numbers is the final case number. The number should also appear on the covering letter that we sent to you.
Respondent details
Please tell us whether you are an individual or a business. You should select "business" if you are a limited company, a partnership or an LLP (limited liability partnership) or a sole trader.
Fast track communication
We will send all correspondence to you by first class post. We can also correspond with you by ONE method of fast track communication (either e-mail or fax). If you wish to receive fast track communication, please specify which method you would prefer, and ensure that you have provided complete and accurate contact details in the Contact details section.
Contact details
Please tell us whether or not you wish to appoint a representative to deal with correspondence from us. Your representative may be any other person, company or lawyer.
If you wish to respond in person, please provide the additional information requested.
If you wish to appoint a representative, please provide your representative's full details, including your representative's reference for this matter, if applicable.
It is vital that this information is complete and accurate, as we will use it in order to send all communications to you or your representative.
The Response
When filling out the Response Form remember that all complaints are decided solely on the terms of the Nominet DRS Policy and submissions addressing non-relevant issues are unlikely to help your case. A DRS response will look something like this when it is filled in. Please note that this will be generated by our system once you have been through the online form. You should always use the online forms as this will allow us to process your case more quickly and reliably as your complaint will be fed automatically into our case management software.
Remember, you should use the online forms to file your Response. If you do not, please remember that there is some extra standard wording which you should include: see the Procedure paragraph 5.
Legal Proceedings
Please inform us if the Domain Name is the subject of legal proceedings, and if so, tell us the outcome of the proceedings.
Respondent's warranties
Please ensure that you have read and understood the warranties (legal promises) contained in this section. Your response will not be valid unless you have ticked the box to represent your agreement to these promises.
If you have documentation to support your response, please attach it to the hard copy of this form before posting it to Nominet.
If you indicate that you intend to attach annexes, please send the hard copy and annexes by post on the same day that you submit your electronic form. Nominet will not process your response until we have received a signed hard copy of your response together with a complete copy of the annexes. You should ensure that you post the hard copy of your response and annexes in good time to meet the deadline for filing your response.
If you indicate that you do not intend to attach annexes, Nominet will not accept any annexes in respect of your response, but will process the response on the basis of your electronic submission.
Please sign and date the hard copy version of this document, remembering to attach any supporting documentation.
Sending us the Response
You will have to click 'Submit' to send the electronic copy. In addition to this you must send the signed hard copy version (plus three copies of any exhibits/annexes) to us before we can accept your Response.
